Township Establishment Application

Township Establishment Application

This application is a complex process of converting agricultural land into residential, commercial or industrial properties. The application makes provision to create a township for land uses according to the Spatial Development Plan. The application follows a legal public participation process and takes up to 8 – 12 months for approval if no objections are received during the advertisement process. The actual proclamation of the township takes a further 6 -8 months due to the legal processes to be follow as per the conditions of establishment.

Traffic study, Environmental Impact assessment, engineering services reports, geology report, land surveyor report and conveying report have to be submitted with this application for evaluation of the township.

Once a township is approved, a General Plan must be lodged for approval by the Office of the Surveyor General, the township register must be opened and all the conditions of approval must be adhered to in order to get the township proclaimed.

Rezoning Application

Rezoning Application

The change of a use zone to allow for certain land use rights on a property. This application relates to new land use rights for a property if the new land uses are in line with the Spatial Development Plan of that area. A public participation process must be followed and such an application takes 6-8 months for approval if no objections are lodged to such a new application.

Subdivision Application

Subdivision Application

The dividing of land or an erf into two or more portions within urban development boundaries. The division application depends on the size of the original erf. The density of the Spatial Development Plan of the Municipality will determine the size of the new erven to be created by the subdivision. No public participation process needed. This application takes approximately 3 4- months for approval.

Consolidation Application

Consolidation Application

Application can be made for the consolidation of two or more properties with the same zoning and same owner. This will allow the owner to build over the building lines. This application takes 3-4 months for approval. No public participation is required with this application.

Division of Land Application

Division of Land Application

Dividing of farm land or holdings into two or more portions. The size of the division portions to be created depends on the density plan for the area. The division of farm land also depends on the availability of water, sewage and necessary engineering services. A public participation process is to take place. This application takes 6-7 months for approval.

Removal of Restrictive Title Conditions Application

Removal of Restrictive Title Conditions Application

Removal of any restrictive conditions in the title deed of properties that prohibit owners from exercising certain land use rights on their land. This application also allows for consent from Council in terms of the title deed of their properties. A public participation process has to be followed with this application and the approval is also promulgated in the Provincial Gazette. This application takes approximately 4 months for approval.

This service is mostly applicable when a person or organisation wants to acquire land that belongs to the government or municipality.

Consent Use Application

Consent Use Application

Obtaining permission to exercise a certain land use right on a property without having to change its zoning. Certain secondary rights are applicable per land use table and a consent use application can be made for that land use. A public participation process is also part of this application. This application can be finalised and approved within 4 – 6 months.
